It is Ordered that the motions and cross motion are consolidated for disposition. It is further Ordered that plaintiff-appellant's cross motion to consolidate the appeals and to produce one record and one brief is granted, and plaintiff-appellant is directed to perfect its appeal by no later than the November 2012 term - the filing deadline is September 11, 2012. In the event of plaintiff-appellant's failure to comply with the foregoing condition, defendant-respondent may move, on five days' notice, for an order dismissing the consolidated appeals.
