Motion by the petitioner for leave to appeal to the Court of Appeals from a decision, order and judgment of this Court, dated May 8, 2012, which determined a proceeding pursuant to CPLR article 78, inter alia, in effect, in the nature of prohibition to prohibit the respondent Yvonne Lewis, a Justice of the Supreme Court, Kings County, from enforcing an order dated December 22, 2011, and entered in an underlying civil action entitled Daniels v City of New York, commenced in the Supreme Court, Kings County, under Index No. 16117/09.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
