It is Ordered that the motion and cross motions are consolidated for disposition. It is further Ordered that defendants-respondents' motion and cross-motion to dismiss the appeal are denied, and defendants-respondents are permitted to serve and file answering briefs by October 2, 2012. Reply briefs, if any, are to be served and filed by October 11, 2012. Plaintiff-appellant's cross-motion is granted only to the extent of permitting amended appellant's briefs to be filed for the November 2012 term - the filing deadline is September 11, 2012. The original file of the New York Civil Court will be transferred to this Court.
