Application by the appellant on an appeal from a judgment of the County Court, Westchester County, rendered September 12, 2006, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to comply with a decision and order on motion of this Court dated July 10, 2012, which directed the appellant's newly assigned counsel to review the brief filed by former assigned counsel and either (1) notify the Court in writing that he adopts the brief filed by former assigned counsel, (2) serve and file a supplemental brief, or (3) serve and file a replacement brief on or before August 9, 2012.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the appellant's time to comply with the decision and order on motion of this Court dated July 10, 2012, is extended until October 15, 2012.
