Bldg Mgt. Co. Inc. v Schroder, Jonathan
It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that tenant-respondent's motion to dismiss the appeal, to vacate the stay and to direct the release of monies deposited with the Clerk of the Civil Court is granted, unless landlord-appellant perfects its appeal by no later than the December 2012 term - the filing deadline is October 10, 2012. In the event of landlord-appellant's failure to comply with the foregoing condition, tenant-respondent may move, on five days' notice, for an order vacating the stay, dismissing the appeal and releasing the deposited funds.
