DECISION & ORDER ON MOTION

Motion by the appellant pro se, in effect, to confirm that he is eligible for poor person relief and the assignment of counsel on an appeal from a judgment of the County Court, Suffolk County, rendered March 31, 2005, in the event that his retained counsel abandons the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied as academic as retained counsel filed a brief on August 14, 2012.
