ORDERED that the order of this court dated July 16, 2012, which dismissed an appeal from an order of the Justice Court of the Town of Southold, Suffolk County, entered July 19, 2011, is recalled and vacated; and it is further,
ORDERED that respondent shall have 21 days from the date of this decision and order to serve and file a respondent's brief; and it is further,
ORDERED that appellant, if it be so advised, may serve and file a reply brief within 14 days of the date that the respondent's brief is due to be filed pursuant to this decision and order.
