| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, for leave to reargue his prior motion for leave to reargue his application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated November 26, 2001 (People v Spragion, 288 AD2d 498), affirming a judgment of the Supreme Court, Kings County, rendered August 13, 1999. The application was determined by decision and order of this Court dated January 31, 2012. The prior motion for leave to reargue the application was determined by decision and order of this Court dated June 12, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
