DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Kings County, rendered April 8, 2010, to continue a stay of execution of said judgment, which was granted by an order of the Supreme Court, Kings County, dated April 23, 2012. Separate motion by the appellant to hold the appeal in abeyance pending determination of his motion pursuant to CPL 440.10 by the Supreme Court, Kings County.

Upon the papers filed in support of the motion to continue the stay of execution of the judgment and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion to hold the appeal in abeyance and the papers filed in relation thereto, it is

ORDERED that the motion to continue the stay of execution of the judgment is denied as unnecessary as the appeal has been perfected (see CPL 460.50[4]); and it is further,

ORDERED that the motion to hold the appeal in abeyance is granted, and the appellant shall notify the Court expeditiously after his motion pursuant to CPL 440.10 is determined by the Supreme Court, Kings County.
