| DECISION & ORDER ON MOTION |
Motion by the respondents-appellants Ivy Asset Management Corp. and Ivy Asset Management, LLC, inter alia, to enlarge their time and the time of the respondents-appellants Beacon Associates Management Corp., Joel Danziger, and Harris Markhoff to serve and file their briefs on an appeal and cross appeals from an order of the Supreme Court, Nassau County, dated August 11, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to enlarge the time of the respondents-appellants Ivy Asset Management Corp. and Ivy Asset Management, LLC, and the time of the respondents-appellants Beacon Associates Management Corp., Joel Danziger, and Harris Markhoff to serve and file their respective briefs is granted, the time to serve and file the briefs is enlarged until October 29, 2012, and those briefs, including the points of argument on the cross appeals (see 22 NYCRR 670.8[c][3]), must be served and filed on or before that date; and it is further,
ORDERED that no further enlargement of time shall be granted; and it is further,
ORDERED that on the Court's own motion, the appellants-respondents shall serve and file their reply brief, if any, on or before November 13, 2012; and it is further,
ORDERED that the motion is otherwise denied.
