ORDERED that the decision and order on motion of this court dated August 20, 2012, in the above-entitled appeal, is recalled and vacated and the following decision and order on motion is substituted therefor:
Motion by defendant for a stay pending the determination of a purported appeal from a judgment of the Civil Court of the City of New York, Kings County, entered November 30, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied as no notice of appeal from the judgment entered November 30, 2011 has been filed in the Civil Court.
