DECISION & ORDER ON MOTION

Motion by Donald Felix for leave to appeal to this Court from two orders of the Supreme Court, Nassau County, dated July 31, 2012, and August 3, 2012, respectively, and to stay enforcement of temporary restraining orders contained in the orders, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied without prejudice to seeking relief in the Supreme Court, Nassau County, based on the defendant's withdrawal of an appeal from an order of the Supreme Court, Nassau County, dated March 22, 2012, under Appellate Division Docket No. 2012-05870; and it is further,

ORDERED that the motion is otherwise denied as academic.
