DECISION & ORDER ON MOTION

Appeal by John Goncalves from an order of the Supreme Court, Nassau County, dated May 10, 2012. By decision and order on motion of this Court dated July 2, 2012, enforcement of so much of the order dated May 10, 2012, as prohibited the parties from removing, causing, or permitting removal of their children from New York State was stayed pending hearing and determination of the appeal on condition that the appeal was perfected on or before August 16, 2012. The appeal has not been perfected.

Now, on the Court's own motion, it is

ORDERED that the stay granted by the decision and order on motion of this Court dated July 2, 2012, is vacated.
