| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the record on an appeal from an order of the Family Court, Suffolk County, dated March 1, 2012, to include the court file and proceedings in a matter entitled Matter of Jose A. L., commenced in the Family Court, Suffolk County, under Docket No. D-2089/12.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings in the matter entitled Matter of Jose A. L., commenced in the Family Court, Suffolk County, under Docket No. D-2089/12, if any, within 45 days of the date of this decision and order on motion, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the attorney for the juvenile, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the attorney for the juvenile. The attorney for the juvenile is directed to provide copies of said transcripts to all of the other parties to the appeal, when the attorney for the juvenile serves a brief upon those parties; and it is further,
ORDERED that the attorney for the juvenile shall serve a copy of this order upon the clerk of the court from which the appeal is taken; and it is further,
ORDERED that in the event the file under Docket No. D-2089/12 has been sealed, it is hereby unsealed for the limited purpose of the attorney for the juvenile or his representative access to the record for the purpose of preparing the appeal; such access shall include permission to copy the papers insofar as they pertain to the appellant.
