Respondent Rita J. Biondo (respondent) having moved for an extension of time to file and serve a brief on the appeals taken herein from an order and judgment and an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on April 1, 2011 (CA 11-02557), and June 15, 2012 (CA 12-01326), and
Appellant having cross-moved to consolidate the appeals from the order and judgment and order entered April 1, 2011, and June 15, 2012,
Now, upon reading and filing the affirmations of Elizabeth A. Bruce, Esq., dated August 23, 2012, the affirmation of Lawrence A. Schulz, Esq, dated September 5, 2012, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that respondent's motions are granted on the condition that the briefs are filed and served on or before October 9, 2012, and the Clerk is directed to accept the briefs for filing, and
It is further ORDERED that reply briefs, if any, shall be filed and served on or before October 24, 2012, and
It is further ORDERED that appellant's cross motion is denied.
