It is hereby ORDERED that the motion seeking to vacate the dismissal of the appeal taken from a judgment of Supreme Court, Erie County rendered May 27, 2009 is granted, on the condition that the appeal is perfected on or before January 9, 2013, and
It is further ORDERED that the appeal taken from the judgment of Supreme Court, Erie County rendered May 27, 2009 (KA 11-02104) may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c) (1) and ten copies of the appellant's brief, reproduced in accordance with 22 NYCRR 1000.4 (f), and
