DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Family Court, Suffolk County, dated August 13, 2012, and, in effect, to continue the child support and maintenance provisions of an order of the same court dated June 25, 2012, pending hearing and determination of an appeal from the order dated August 13, 2012.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and enforcement of the order dated August 13, 2012, is stayed and the child support and maintenance provisions of the order dated June 25, 2012, are continued, pending hearing and determination of the appeal from the order dated August 13, 2012, on condition that the appeal is perfected on or before October 22, 2012; and it is further,

ORDERED that in the event the appeal is not perfected on or before October 22, 2012, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
