Motion by the appellant Nicole Halkiopoulos to recall and vacate so much of a decision and order on motion of this Court dated May 2, 2012, as dismissed her appeals from an order of the Supreme Court, Queens County, dated March 25, 2011, two orders of the same court both dated April 11, 2011, and an order and judgment (one paper) of the same court dated April 20, 2011, for failure to timely perfect, to reinstate the appeals, and to enlarge the time to perfect the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and so much of the decision and order on motion of this Court dated May 2, 2012, as dismissed the appeals by the appellant Nicole Halkiopoulos is recalled and vacated, those appeals are reinstated, and the appellant Nicole Halkiopoulos's time to perfect her appeals is enlarged until December 4, 2012; and it is further,

ORDERED that on the Court's own motion, within 10 days from the date of this decision and order on motion, the attorney for the respondent is directed to serve a copy thereof upon the appellant Nicole Halkiopoulos pursuant to CPLR 2103(b)(1) or (2), and (c), and to file proof of such service in the office of the Clerk of this Court within five days thereafter, which service shall constitute notice to the appellant Nicole Halkiopoulos to appoint a new attorney pursuant to CPLR 321(c); and it is further,

ORDERED that within 30 days after service upon her of a copy of this decision and order on motion, the appellant Nicole Halkiopoulos shall appoint a new attorney and advise the Clerk of this Court and the respondent's counsel of that attorney's name and address, or advise the Clerk of this Court and the respondent's counsel that she is proceeding pro se; and it is further,

ORDERED that on the Court's own motion, the time to perfect the appeal by the appellants Mercury Financial Services, LLC, SG Realty Properties, LLC, and Chris Papandrea from

the order dated April 11, 2011, under Appellate Division Docket No. 2011-06115, is enlarged until December 4, 2012.
