Winneth Charles and Edd Kelly, Respondents, v Sunlight Linen Corp. and Marcos Gomez, Appellants.

Motion by appellants on an appeal from an order of the Civil Court of the City of New York, Kings County, entered May 14, 2008, to compel the settlement of transcripts. Cross motion by respondents to dismiss the appeal for failure to prosecute.

Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as moot, as the transcripts have now been settled; and it is further,

ORDERED that the cross motion is denied.
