DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Michael Carden, Appellant.

Motion by appellant for a preference in the hearing of an appeal from a judgment of conviction of the Justice Court of the Town of Wappinger, Dutchess County, rendered March 22, 2012, and to add a letter from the Dutchess County Sheriff's Department to the record on appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking a preference in the hearing of the appeal is granted and the matter shall be placed on the October 4, 2012 calendar; and it is further,

ORDERED that respondent shall serve and file its brief by September 26, 2012; and it is further,

ORDERED that the branch of the motion seeking to add a letter from the Dutchess County Sheriff's Department to the record on appeal is granted.
