DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78, inter alia, in the nature of mandamus to compel "the immediate final accounting" of the subject estate and for poor person relief.

On the Court's own motion, it is

ORDERED that the proceeding is dismissed, without costs or disbursements, for failure to provide proof of service of the order to show cause and verified petition which commenced the proceeding.
