DECISION & ORDER ON MOTION

Appeal by Dean T. Hansen from an order of the Family Court, Suffolk County, dated February 21, 2012. By decision and order on motion dated July 24, 2012, the appellant's time to file an affidavit or affirmation in accordance with a scheduling order dated April 19, 2012, was extended until August 24, 2012. The appellant has failed to file the affidavit or affirmation.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure file the affidavit or affirmation in accordance with the prior orders of the Court (see 22 NYCRR 670.4[a][4]).
