Motion by the respondent to strike the appellant's brief on an appeal from an order of the Family Court, Richmond County, dated October 21, 2011, on the ground that it raises issues not properly before the Court. Application by the appellant for leave to file a replacement brief.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion and the application are granted, the appellant's brief is stricken, and on or before October 31, 2012, the appellant shall serve and file a replacement brief.
