ORDERED that this court's decision and order on motion dated December 8, 2011, in the above-entitled case, which dismissed an appeal from an order of the Justice Court of the Village of Hempstead, Nassau County, entered June 6, 2011, is recalled and vacated, defendant's notice of appeal from the order entered June 6, 2011 is deemed a timely application for leave to appeal from that order, and the application is referred to Justice Nicolai for determination.
