David Zelman, Respondent, v Jenny Elbaz, Appellant.

Motion by appellant on an appeal from an order of the Civil Court of the City of New York, Kings County, dated May 31, 2012, to continue a stay contained in a decision and order of this court dated June 27, 2012, as modified by a decision and order of this court dated July 27, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted on condition that appellant continues to comply with the terms of the decision and order of this court dated July 27, 2012; and it is further,

ORDERED that in the event that any of the conditions contained in the decision and order of this court dated July 27, 2012 are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
