DECISION & ORDER ON MOTION

Appeal by Jakeina Wingate from an order of the Family Court, Westchester County, dated December 22, 2011. The appellant has failed to timely perfect the appeal and has not moved to renew her prior motion for leave to prosecute the appeal as a poor person and for the assignment of counsel within the time frame directed by a decision and order on motion of this Court dated August 15, 2012.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements (see 22 NYCRR 670.4, 670.8[e]).

ENG, P.J., FLORIO, LEVENTHAL and MILLER, JJ., concur.
