Motion by 4815 Development Corp., inter alia, to stay the trial in the above-entitled action pending hearing and determination of appeals from an order of the Supreme Court, Queens County, dated June 5, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that on the Court's own motion, the appeal by 4815 Development Corp. is dismissed, without costs or disbursements, on the ground that it is not aggrieved by the order dated June 5, 2012 (see CPLR 5511); and it is further,
ORDERED that the branch of the motion which is to stay the trial is denied and the motion is otherwise denied as academic.
