| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by Dennis J. Pottinger for reinstatement to the Bar as an attorney and counselor-at-law. In a related proceeding, by opinion and order of this Court dated January 9, 1995, as amended January 17, 1995, Mr. Pottinger was suspended from the practice of law for a period of three years, effective February 9, 1995 (Matter of Pottinger, 207 AD2d 128 [Appellate Division Docket No. 1990-06354]). Mr. Pottinger was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on September 30, 1987. By decision and order on motion of this Court dated May 23, 1995, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute this disciplinary proceeding against Mr. Pottinger and the issues were referred to J. Mitchell Rosenberg, as Special Referee to hear and report. By opinion and order of this Court dated July 28, 1997, Mr. Pottinger was disbarred based on 18 charges of professional misconduct.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied.
We find that Dennis J. Pottinger does not demonstrate the requisite fitness and character to practice law.
