| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Westchester County, dated August 12, 2011, to appoint an administrator for the deceased respondent, James Cecere, to substitute the administrator for the deceased respondent, and to amend the caption accordingly.
Upon the papers filed in support of the motion and no papers have been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied without prejudice to making a motion in the Surrogate's Court or the Supreme Court, Westchester County, for the appointment of an administrator for the deceased respondent and then making a motion in this Court to substitute the administrator for the deceased respondent.
