| DECISION & ORDER ON MOTION |
Motion by the appellants to enjoin the Board of Elections in the City of New York from "building" ballots for the general election to be held on November 6, 2012, pending hearing and determination of an appeal from an order of the Supreme Court, Kings County, dated September 20, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic, as the appeal has been determined (see Matter of Tischler v Neuman, ____ AD3d ____ [2d Dept, Oct. 5, 2012]).
