| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated March 5, 2012, (1) to stay all proceedings in a matter entitled Novelty Crystal Corp. v Yue Fung USA Enterprises, Inc., pending in the Supreme Court, Queens County, under Index No. 701615/12, pending hearing and determination of the appeal, (2) to hold the respondent in contempt for violating a decision and order on motion of this Court dated May 17, 2012, and (3) for an award of an attorney's fee and costs.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay all proceedings in the matter entitled Novelty Crystal Corp. v Yue Fung USA Enterprises, Inc., pending in the Supreme Court, Queens County, under Index No. 701615/12, is granted, and all proceedings in the matter entitled Novelty Crystal Corp. v Yue Fung USA Enterprises, Inc., pending in the Supreme Court, Queens County, under Index No. 701615/12, are stayed pending hearing and determination of the appeal; and it is further,
ORDERED that the motion is otherwise denied.
