DECISION & ORDER ON MOTION

Motion by the petitioner for leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated September 12, 2012, and to enjoin the respondent from enforcing a certain condition in a certificate of occupancy and special use permit for the petitioner's premises, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
