DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute an appeal from an order of the Supreme Court, Kings County, dated February 1, 2012, as a poor person and to enlarge the time to perfect the appeal. Separate motion by the appellant for leave to enter a default judgment against the respondent, to hold the respondent in contempt, and for poor person relief.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to prosecute the appeal as a poor person, and the separate motion for leave to enter a default judgment against the respondent, to hold the respondent in contempt, and for poor person relief, are denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until December 3, 2012, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
