Now, upon reading and filing the affirmation of Melanie J. Beardsley, Esq., dated September 14, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is dismissed without prejudice to the filing of a motion to vacate the order pursuant to CPLR 5704 (a) (see 22 NYCRR 1000.13 [b] [2]).
