It is Ordered that plaintiffs-respondents' motion to dismiss the appeal from an order dated September 30, 2010 for failing to timely perfect is granted and the funds deposited with the Commissioner of Finance of the City of New York, plus interest and less any costs, are to be released to plaintiffs-respondents, Jeffrey Schnipper and Cari Schnipper.
