ORDER ON APPLICATION

Application pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file the answering briefs and reply briefs on appeals and cross appeals from an order of the Supreme Court, Westchester County, dated January 5, 2012.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and the time of Metropolitan Transit Authority and Metro-North Railroad shall serve and file their answering brief, including their points of argument on their cross appeal, on or before November 7, 2012; and it is further,

ORDERED that the Samuel Cockburn & Sons, Inc., shall serve and file its answering brief, if any, including its points of argument on its cross appeal, on or before December 12, 2012; and it is further,

ORDERED that the plaintiffs-respondents shall serve and file a brief, if any, on or before January 16, 2013; and it is further,

ORDERED that the appellant-respondent shall serve and file a reply brief, if any, on or before February 20, 2013, the respondents-appellants Metropolitan Transportation Authority and

Metro-North Railroad shall serve and file a reply brief on or before March 27, 2013, and the respondent-appellant Samuel Cockburn & Sons, Inc., shall serve and file its reply brief on or before May 3, 2013.
