ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the respondents-appellants' reply brief is stricken, and on or before November 8, 2012, the respondents-appellants' may serve and file a replacement reply brief that does not raise any new issues or move for leave to file a supplemental brief.
