Motion by the appellant-respondent for leave to file a sur-reply brief on an appeal from an order of the Supreme Court, Nassau County, dated February 2, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, the respondents-appellants' reply brief is stricken, and on or before November 8, 2012, the respondents-appellants' may serve and file a replacement reply brief that does not raise any new issues or move for leave to file a supplemental brief.
