Defendants-appellants having moved, upon the return of an order to show cause granted by the Honorable Erin M. Peradotto on September 27, 2012, for a stay of all proceedings to enforce the orders of the Supreme Court entered in the Office of the Clerk of the County of Niagara on March 1, 2012, and August 2, 2012, pending the hearing and determination of the appeals taken herein,
Now, upon reading and filing the affidavits of Michael B. Powers, Esq., sworn to September 26, 2012, and October 11, 2012, said show cause order with proof of service thereof, and the affidavit of Gregory P. Photiadis, Esq., sworn to October 9, 2012, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the part of the order entered August 2, 2012, compelling discovery from non-parties and relative to plaintiff-respondent's cause of action for lien foreclosure is stayed pending the determination of the appeal from that order, on the condition that defendants-appellants perfect their appeals on or before November 23, 2012, with the exception that Supreme Court may execute the commission for non-party Kemper Sports Management, Inc.
