Motion by appellant to withdraw an appeal from a decision of the Civil Court of the City of New York, Kings County, entered April 17, 2012, and for an order directing the release of funds on deposit to respondent.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to withdraw the appeal is granted and the appeal is marked withdrawn; and it is further,
ORDERED that the branch of the motion seeking an order directing the release of funds on deposit is granted and the New York City Department of Finance is directed to release the funds on deposit in this matter to respondent Throop Court, LP, less any lawful fees.
