DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from a judgment of the District of Suffolk County, Third District, entered February 16, 2012, for failure to prosecute. Separate motion by appellant for an enlargement of time to serve and file papers in opposition to respondent's motion.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that respondent's motion and appellant's motion are consolidated for purposes of disposition; and it is further,
ORDERED, on the court's own motion, that the appeal is dismissed on the ground that no appeal lies from a decision (see UDCA 1702; Hall v Paez, 77 AD3d 620 [2010]); and it is further,
ORDERED that respondent's motion and appellant's motion are denied as moot.
