Motion by the appellant, in effect, to recall and vacate a decision and order on motion of this Court dated August 29, 2012, which dismissed an appeal from a decision of the Supreme Court, Kings County, dated April 24, 2012, and to waive the motion filing fee.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that the motion is otherwise denied.
