| DECISION & ORDER ON MOTION |
Motion by Kaitlin Ward, inter alia, for leave to appeal to this Court from so much of an order of the Supreme Court, Kings County, dated October 10, 2012, as sua sponte dismissed the first, second, and fourth causes of action, and to stay the respondents from terminating her lease, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is granted; and it is further,
ORDERED that the motion is otherwise denied.
