Appellant having moved to adjourn oral argument of the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on January 3, 2012 (CA 12-01192), so that it can be heard with the appeal from an order of said court entered on September 4, 2012 (CA 12-01685), and having moved for other relief in the alternative,
Now, upon reading and filing the affirmation of James L. Alexander, Esq., dated October 18, 2012, the notice of motion with proof of service thereof, and the affidavit of Christina F. DeJoseph, Esq., sworn to November 8, 2012, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the appeal from the order entered January 3, 2012, shall be removed from the Court's day calendar for December 6, 2012, and added to the calendar for the term of this Court commencing February 19, 2013.
