DECISION & ORDER ON MOTION

Motion by Emanuel A. Towns, inter alia, (1) for reinstatement to the Bar as an attorney and counselor-at-law; (2) to set the amount of restitution to be paid at the sum of $23,950; and (3) for leave to satisfy the restitution requirement by providing 96 hours of legal services to a "Court Sponsored Volunteer Attorney Program." Mr. Towns was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 23, 1974, under the name Emanuel Alexander Towns. By decision and order on application of this Court dated November 7, 2007, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against Mr. Towns and the issues raised were referred to the Honorable Lawrence J. Bracken, as Special Referee to hear and report. By decision and order on application of this Court dated October 16, 2008, the Honorable Lawrence J. Bracken was relieved as Special Referee, and the issues raised in the petition were reassigned to the Honorable Vincent Pizzuto. By decision and order on application of this Court dated November 25, 2008, the Honorable Vincent Pizzuto was relieved as Special Referee, and the issues raised in the petition were reassigned to John P. Clarke, as Special Referee to hear and report. By opinion and order of this Court dated April 27, 2010, Mr. Towns was suspended from the practice of law for a period of six months, effective May 27, 2010. Based on a finding that appropriate restitution should be made by Mr. Towns, the Court directed Mr. Towns to cooperate with the Grievance Committee in the prompt formulation of an appropriate restitution order.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is to set the amount of restitution at the sum of $23,950 is granted; and it is further,

ORDERED that the motion is otherwise denied.
