DECISION & ORDER ON MOTION

Motion by the respondent for leave to serve and file a replacement brief on an appeal from a judgment of the Supreme Court, Nassau County, rendered June 6, 2011.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the replacement brief served on the appellant and submitted to the Clerk of the Court is accepted for filing; and it is further,

ORDERED that on the Court's own motion, the appellant's time to serve and file a reply brief is enlarged until December 11, 2012, and the reply brief, if any, must be served and filed on or before that date.
