| DECISION & ORDER ON MOTION |
Motion by the appellant to recall and vacate a decision and order on motion of this Court dated April 17, 2012, which dismissed an appeal from a decision of the Supreme Court, Queens County, dated December 7, 2011, and to consolidate that appeal with an appeal from an order of the same court entered June 6, 2012.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to recall and vacate the decision and order on motion of this Court dated April 17, 2012, is denied; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied as academic.
