Now, upon reading and filing the affirmation of Catharine M. Venzon, Esq., dated October 15, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks dismissal of the appeal taken from the order entered December 21, 2011, is granted and the appeal is dismissed as moot, and

It is further ORDERED that the motion insofar as it seeks dismissal of the appeals taken from the orders entered March 9, 2012, and July 26, 2012, is dismissed on the ground that the appeals were dismissed by order entered October 16, 2012.
