DECISION & ORDER ON MOTION

Motion by the appellant to reargue his prior motion, pursuant to CPL 460.20, for a certificate granting leave to appeal to the Court of Appeals from a decision and order of this Court dated March 6, 2012, which denied the appellant's application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated February 9, 2010 (People v Jackson, 70 AD3d 858), affirming a judgment of the County Court, Dutchess County, rendered May 16, 2008. The prior motion for a certificate granting leave to appeal to the Court of Appeals was denied by decision and order on motion of this Court dated August 14, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.
