| DECISION & ORDER ON MOTION |
Motion by the Attorney General of the State of New York (1) on appeals from an order of the Supreme Court, Nassau County, dated July 8, 2011, and (2) appeals from an order of same court entered August 23, 2012, and a judgment of same court entered October 1, 2012, which were transferred to this Court by an order of the Court of Appeals dated October 18, 2012, to dismiss the appeals from the order dated July 8, 2011, on the ground that the right of direct appeal therefrom terminated upon entry of the judgment entered October 1, 2012.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof; and it is further,
ORDERED that on the Court's own motion, the appeals will be calendared together and will be argued or submitted on the same day.
