In the Matter of Sureyya Stefan, appellant,

v Adam Arici, respondent.

(Docket No. F-32985-09/09A)

DECISION & ORDER ON MOTION

Appeal by Sureyya Stefan from an order of the Family Court, Kings County, dated May 18, 2011. By order to show cause dated October 10, 2012, the parties or their attorneys were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the ground that no appeal lies from an order denying reargument.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies from an order denying reargument.

ANGIOLILLO, J.P., DICKERSON, AUSTIN and HINDS-RADIX, JJ., concur.
